GENERAL CONTRACT AND TRAVEL CONDITIONS (GCS)

1) Scope of application.

 

The GTCS apply to reservations made through all the channels managed by Viaggia Con Pasqui, to the extent that such reservations concern "all-inclusive" travel pursuant to art. 1 of the package travel law Federal Law of 18 June 1993 on package travel (LF 944.3).

 

2) Definitions of organizer, seller, consumer.

By travel organizer we mean Viaggia Con Pasqui who organizes all-inclusive trips, realizing the combination of the elements referred to in Article 1 of the Federal Law of 18 June 1993 on "all-inclusive" travel.

By seller we mean the person who offers the all-inclusive trips proposed by the organizer.

By consumer we mean:

a) any person who books or undertakes to book the package travel;

b) any person in whose name or on whose behalf a package holiday is booked or a booking commitment is made;

c) any person to whom the "all inclusive" trip is transferred pursuant to article 17 of the Federal Law of 18 June 1993. In cases where the customer books individual travel services (flight, hotel, rental car, etc.) and composes by organizing the trip independently or the customer books an all-inclusive trip produced by organizers other than Viaggia Con Pasqui, the latter appears exclusively as a mediator of services performed by third parties and can never be considered, in any case, responsible for the correct implementation of the services themselves. In the case of booking individual travel services, the articles relating to the General Conditions of Contract for Individual Services (CGCS) will apply.

 

3) Stipulation of the contract.

When the customer, through one of the distribution channels managed by Viaggia Con Pasqui, books an "all inclusive" trip, presented in a catalog of the organizer or made to measure out of the catalogue, this constitutes a proposal to stipulate a travel contract " all inclusive". Acceptance of reservations is considered completed, with the consequent conclusion of the contract, only when the organizer sends the relative confirmation, also by telematic system, to the consumer at the selling travel agency. Before departure, the organizer will provide the information relating to the all-inclusive trip not contained in the contractual documents, brochures or other written means of communication. If the confirmation is different from the proposal made by the customer, the confirmation itself will have the value of a proposal by the travel organizer and the latter will in turn be bound by the proposal made for a period of seven working days. The contract takes place on these new conditions when the customer accepts the offer within the period of seven working days. The payment by the customer also has the value of acceptance. The proposal accepted by the travel organizer, these GTCS and all the information provided for the realization of the trip constitute the subject of the contract concluded between the customer and the travel organizer.

 

4) Prices.

The price of the trip is determined in the contract, with reference to what is indicated on the site or out-of-catalogue program and any subsequent updates to the same site or out-of-catalogue programs.

It may be changed up to 2 weeks before departure and only as a result of changes in:

• transportation costs, including the cost of fuel;

• duties and taxes on certain types of tourist services such as taxes, fees or landing, disembarkation or embarkation fees in ports and airports;

• exchange rates applied to the package in question.

Viaggia Con Pasqui may apply a commission on all bookings. The rate is communicated to the customer during the booking process before payment confirmation.

Terms of payment. 

The amount of the deposit, up to a maximum of 50% of the travel price, to be paid at the time of booking or at the time of the binding request and the date by which, before departure, the balance must be paid, result from catalogue, brochure or anything else. The issue of the ticket office (air, railway, etc.) must in any case be paid for on the date of issue. Failure to pay the sums referred to above on the established dates constitutes an express termination clause such as to determine, by the selling agency and/or the organizer, the legal termination.

 

5) Substantial and penal modifications.

Before departure, the organizer or intermediary who needs to substantially modify one or more essential elements of the contract, immediately notifies the consumer, indicating the type of modification and the consequent change in price. A price increase is only substantial if it results in an increase of more than 10%. The consumer can accept a substantial modification of the contract or withdraw without compensation. If he withdraws from the contract, he informs the organizer and the seller in writing within 2 days of the communication of the variation; after 2 days without communication, the change will be considered accepted. In the event of substantial changes, if the consumer withdraws from the contract, he has the right alternatively:

• to another "all inclusive" trip of equivalent or higher quality if the organizer or the seller can offer it to him;

• another "all inclusive" trip of lower quality, as well as a refund of the difference;

• the fastest possible repayment of all sums paid.

 

The consumer can exercise the rights provided above even when the cancellation depends on the failure to reach the minimum number of participants envisaged at the time of booking or in the out-of-catalogue Program or by cases of force majeure or unforeseeable circumstances relating to the trip purchased. The consumer who withdraws from the contract before departure outside of the aforementioned hypotheses (substantial changes, failure to reach the minimum number, force majeure, unforeseeable circumstances relating to the trip purchased) will be charged – regardless of the payment of the deposit pursuant to art. 5 paragraph 1 - the individual cost of file management, the penalty to the extent indicated in the technical data sheet of the Catalog or Non-catalog Program or tailor-made trip, any consideration for insurance coverage already requested at the time of conclusion of the contract or for other services already returns. In the case of pre-established groups, these sums will be agreed from time to time upon signing the contract.

 

6) Cancellation protection.

 

6.1 Conclusion of the insurance.

We recommend that you take out cancellation insurance if you do not already have one that has sufficient cover. Furthermore, it is advisable to take out medical insurance valid in the country where the booked trip takes place. The cost of the insurance must be paid in addition to the price of the agreed package.

 

6.2 Insurance Coverage.

In the event of cancellation of the trip, the insurance premium will remain due. Travel assistance insurance coverage is not included, but can be completed through a Viaggia Con Pasqui’s insurance partner.

 

7) Transfer of the reservation.

The consumer who is prevented from undertaking the "all inclusive" trip can transfer the reservation to a person who meets all the required conditions, if the organizer or the seller is previously informed no later than 4 working days before the date of departure. The transferee and the consumer are jointly liable to the organizer or the contracting seller for the payment of the price and any additional costs resulting from the transfer.

 

8) Health information and documents for expatriation.

During the negotiations and in any case before the conclusion of the contract, Italian citizens are provided with general information - updated at the date of printing of the catalog - relating to health obligations and the documentation necessary for expatriation. In any case, before departure, consumers will check that it is updated with the competent authorities, adapting it before the trip. In the absence of this verification, no responsibility for the non-departure of one or more consumers can be attributed to the seller or the organizer. Consumers must inform the seller and the organizer of their citizenship and, upon departure, must definitively make sure that they are in possession of vaccination certificates, an individual passport and any other valid document for all the countries covered by the itinerary, as well as residence visas, transit visas and health certificates that may be required.

9) Claims and complaints.

Any failure in the execution of the contract must be contested by the consumer during the use of the trip by timely presentation of a complaint so that the organizer, his local representative or the guide can promptly remedy it. Otherwise, the compensation for damages will be reduced or excluded. The consumer must also - under penalty of forfeiture - file a complaint by sending a written communication, which guarantees proof of receipt, to the organizer or intermediary, no later than ten working days from the date of return to the place starting.

 

10) Responsibility.

The organizer is liable for damages caused to the consumer due to the total or partial non-fulfilment of the contractually owed services, whether these are performed by him personally or by third party service providers, unless he proves that the event is derived from a fact of the consumer (including initiatives autonomously undertaken by the latter during the execution of the tourist services) or by a third party event of an unforeseeable or inevitable nature, by circumstances unrelated to the provision of the services provided for in the contract, by chance, by force greater, or from circumstances that the organizer himself could not, according to professional diligence, reasonably foresee or resolve. The seller with whom the all-inclusive travel reservation was made is not responsible in any case for the obligations arising from the travel organization. With the exception of bodily injury deriving from the non-fulfillment or bad execution of the contract, the compensation is always limited to double the price of the all-inclusive trip.

 

11) Data protection.

The protection of the private sphere and the personal environment of customers is of great value for Viaggia Con Pasqui. 

Viaggia Con Pasqui processes the personal data communicated to you exclusively in compliance with the Italian law on the processing of personal data, for the purpose of implementing the contract.

 

12) Variation of the General Contract and Travel Conditions.

Viaggia Con Pasqui reserves the right to modify these GCS at any time and without giving prior notice.

 

13) Validity of the General Contract and Travel Conditions.

The invalidity of one or more provisions of these GTCS does not affect the validity of the remaining provisions of the GTCS. However, the valid provisions remain in force. The invalidated provision must be replaced by an equivalent provision which corresponds to the commercial purpose of the invalidated one.

 

14) Applicable laws and competent court.

The contract between the customer and the organizer and/or seller, including the question of the implementation and validity of the contract, is subject exclusively to Italian law.

16) General Conditions of Contract for Individual Services (CGCS).

The relative international conventions and the following clauses of the general contract and travel conditions (CGCV) above are applicable to these contracts: art.5; art.7; art. 9; art. 10.

The application of these clauses in no way determines the configuration of the related services as a case of all-inclusive travel. The terminology of the aforementioned clauses relating to the all-inclusive travel contract (organizer, travel, etc.) must therefore be understood with reference to the corresponding figures of the sales contract for individual tourist services (seller, stay, etc.)

In cases where the customer books single travel services (flight, hotel, rental car, etc.) or several single services and composes them by organizing the trip independently, the selling agency appears exclusively as a mediator of services performed by third parties and can never be considered, in any case, responsible for the correct implementation of the services themselves.

 

17) Content and navigation with the site and/or social profiles.

Each user browses our site and/or social profiles at their own responsibility. The navigation technique represents the standards currently in vogue. Should technical problems arise in the user's system, we discharge ourselves of any responsibility. The contents should not offend any third party and, if this were the case, we ask anyone to contact Viaggia con Pasqui in writing for any complaints. The offers and prices expressed on the site and/or social profile are to be interpreted as indicative and not definitive. In fact, the prices are calculated starting from various international currencies and conditions of third-party suppliers which may undergo variations, sometimes even strong ones. The photographs and images used on this site are the property of Viaggia con Pasqui and cannot under any circumstances be downloaded and reused by virtue of the Commons currently in force for archive images or photographers under contract.

 

18) Cookies & Privacy.

This site uses cookies whose purpose is to evaluate and control navigation data (statistics for contents and pages). The data is normally stored in Google Analytics for 26 months and then irrevocably destroyed. No data or IP address is provided to third parties by Viaggia Con Pasqui. As the contracts will be performed in Italy but with contacts with other European countries, we certify that Viaggia Con Pasqui complies in all its aspects with the GDPR which entered into force in 2018.
